The assessment of the possible impact of the intended activity upon protected nature territories of European significance (NATURA 2000)
If such activity is intended the implementation of which according to the decision of the State Environmental Service may have a substantial impact upon the protected nature territories of European significance (NATURA 2000) but which is not referred to in Annex 1 to the Law on Environmental Impact Assessment and for the implementation of which the impact assessment need not be performed, its impact upon the protected nature territories of European significance (NATURA 2000) shall be assessed in accordance with the procedures laid down separately, which is determined by the Cabinet Regulation No. 300 of 19 April 2011 “Procedures how impact on specially protected nature areas of European significance (Natura 2000) is assessed“.
The decision on the application of the NATURA 2000 Site Impact Assessment is made in the initial environmental impact assessment process by the regional environmental board of the SES, or the ESB may include the requirement to perform the NATURA 2000 site impact assessment in the EIA process. In this case the EIA Program also includes requirements for NATURA 2000 site impact assessments.
After the application of the NATURA 2000 Site Impact Assessment, the conditions of ESB for the performance of the NATURA 2000 Site Impact Assessment shall be requested.
In accordance with these conditions and the requirements included in the Cabinet Regulation No. 300, an assessment shall be performed and the results thereof shall be summarized in the Report.
Within 60 days after the receipt of the report of the initiator of the activity on the possible impact upon the protected nature territories of European significance (NATURA 2000), the ESB shall issue an opinion on the Report.
If, in accordance with the Law “On Specially Protected Nature Territories”, it is necessary to receive the opinion of the European Commission for the performance of the intended activity, the ESB shall provide the opinion within 45 days after receipt of the opinion of the European Commission.
